29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: (a) Star residential construction site: On or about March 18, 2020 and at times prior to, employees were setting roof paper on a residential roof with an approximate 30 foot fall hazard from peak to ground without any means of fall protection. Note: Abatement certification is required for this item.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards: (a) Star residential construction site: On or about March 18, 2020 and at times prior to, employees were engaged in roofing activities and had not been adequately trained as to the hazards and awareness of working at 30 feet without adequate fall protection. Note: Abatement certification is required for this item.
