29 CFR 1926.304(d): Portable, power-driven circular saw(s) were not equipped with a guard above and below the base plate or shoe:  a) New townhome construction located on Lot #50, Front side at cut bench: On or about 03/26/2020, and at times prior, the employer exposed employees to severe laceration and amputation hazards while operating circular saws, in that the lower guards were shimmed preventing the lower guard from retracting while cutting cornice and trim boards.

29 CFR 1926.451(c)(2): Supported scaffold poles, legs, posts, frames,  or uprights did not bear on base plates, mud sills or other adequate firm foundation:  a) New townhome construction located on Lot #50, Front side: On or about 03/26/2020, and at times prior, the employer exposed employees to collapse/fall hazards of up to 28-feet to the lower level, in that pump jack support poles were not resting on a firm foundation as employees were engaged in cornice board installation.

29 CFR 1926.452(j)(2): Poles were not secured to the structure by rigid triangular bracing or equivalent at the bottom, top, and other points as necessary.  a) New townhome construction located on Lot #50, Front side: On or about 03/26/2020, and at times prior, the employer exposed employees to collapse/fall hazards of up to 28-feet to the lower level, in that pump jack support poles were not secured at the bottom of the poles while employees were engaged in cornice board installation.

29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section.  a) New townhome construction located on Lot #50, Front side: On or about 03/26/2020, and at times prior, the employer exposed employees to fall hazards of up to 28-feet to the lower level, in that no fall protection was provided to an employee working from a pump jack scaffold system. The exposed employee was wearing a full body harness but was not attached to a life-line or anchor point to prevent falls to the lower level.
