29 CFR 1910.28(b)(1)(i): The employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that was 4 feet (1.2 m) or more above a lower level was protected from falling by one or more of the following: Guardrail systems, safety net systems, or personal fall arrest systems: a) On or about March 11, 2020, in the concrete blocks production area, employees diagnosing a malfunction in the Cuber brake were allowed to climb onto an uneven surface without the use of a fall protection system, exposing to a fall hazard of approximately 13 feet.

29 CFR 1910.178(a)(5): The powered industrial truck was equipped with front-end attachments other than factory installed attachments, however the employer did not request that the truck be marked to identify the attachments and show the approximate weight of the truck and attachment combination at maximum elevation with load laterally centered: a) On or about March 11, 2020, in the production area, at 3144 NE Hwy 17, Arcadia, FL 34266, the employer exposed employees to fall hazards, in that, the Toyota 8FDU32 Forklifts was not marked to identify the Vestil, WP-4848-DD Fork Truck Work Platform. b) On or about March 11, 2020, in the production area, at 3144 NE Hwy 17, Arcadia, FL 34266, the employer exposed employees to fall hazards, in that, the Toyota 8FDU32 Forklifts was not marked to identify the Sanchez Machine Shop Gravity Clamps.
