29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees: Employees were exposed to a fall and cave-in hazards. Employees engaged in water line installation activities, inside of a trench found to be approximately 6 feet wide and 6 1/2 inches in depth, were exposed to fall and cave-in hazards in that a ladder was approximately 35 feet away.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c). Employees were exposed to cave-in hazards. Employees engaged in water line installation activities, inside of a trench found to be approximately 6 feet 5 inches in depth, were exposed to cave-in hazards in that an adequate protective system was not provided.

29 CFR 1926.652(c)(2)(ii): Deviation from the specifications, recommendations, and limitations issued or made by the manufacturer shall only be allowed after the manufacturer issues specific written approval. Employees were exposed to cave-in hazards. Employees engaged in water line installation activities were exposed to cave in hazards. The employees were working inside of a trench that was approximately 6.5ft in depth. The employer allowed employees to go into the trench after making deviations to the installation of vertical aluminum shoring. The competent person did not obtain tabulated data produced by a registered professional engineer that ensured the deviations of the vertical aluminum shoring were with in manufacturers guidelines.
