29 CFR 1926.501(b)(13): Employees engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employees provided with an alternative fall protection measure under another provision of paragraph 1926.501(b):    (a)Daly Custom Homes, Inc. at 1600 East 77th Street, Sioux Falls, SD 57108: On or about and at times prior to March 27, 2020, the employer did not ensure employees were protected from fall hazards. Employees were installing banding on the exterior of floor trusses and did not utilize a fall protection system when exposed to fall hazard in excess of 6 feet above ground level. This condition exposed employees to fall hazards of approximately 15 feet.

29 CFR 1926.502(d)(17): The attachment point of the body belt shall be located in the center of the wearer's back. The attachment point of the body harness was not located in the center of the wearer's back near shoulder level, or above the wearer's head:    (a)Daly Custom Homes, Inc. at 1600 East 77th Street in Sioux Falls, SD 57108: On or about and at times prior to March 27, 2020, the employer did not ensure employees were utilizing the back D-ring located in the center of the wearer's back as an attachment point. An employee was observed using a lanyard snap-hook connected to his belt D-ring as an attachment point. This condition exposed an employee to fall hazard of approximately 15 feet.

29 CFR 1926.1053(b)(4): Ladders shall not be used for purposes other than the purpose for which they were designed:    (a)Daly Custom Homes, Inc. at 1600 East 77th Street in Sioux Falls, SD 57108: On or about and at times prior to March 27, 2020, the employer did not ensure that employees were protected from fall hazards in that, employees utilized the top step of a 6-foot Louisville Cross Step A-frame ladder, Model FXS1506, to access the exterior top plate to install banding on floor trusses. The use of the ladder was contrary to the manufacturer's instructions. This condition exposed employees to fall hazards.
