29 CFR 1926.20(b)(1): It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.   a) Anna MS Inc., at a jobsite located on Belcher Court, Columbus, OH 43224: On and/or preceding March April 8, 2020, the employer failed to initiate and maintain a safety and health program such as but not limited to a personal protective equipment program and a fall protection program for employees working from aerial lifts.

29 CFR 1926.102(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.   a) Anna MS Inc., at a jobsite located at Belcher Court, Columbus, OH 43224: On and/or preceding April 8, 2020, the employer did not ensure employees wore safety glasses while utilizing power tools that presented struck-by hazards to the eyes and face. Carpenters were installing soffit while using a powered nail gun. The employees were not utilizing eye protection, which exposed them to struck-by hazards to the eyes.  b) Anna MS Inc., at a jobsite located at Belcher Court, Columbus, OH 43224: On and/or preceding April 8, 2020, the employer did not ensure employees wore safety glasses while utilizing power tools that presented struck-by hazards to the eyes and face. Carpenters were cutting interior trim while using circular and table saws. The employees were not utilizing eye protection, which exposed them to struck-by hazards to the eyes.

29 CFR 1926.453(b)(2)(v): A body belt shall be worn and a lanyard attached to the boom or basket when working from an aerial lift. Note to paragraph (b)(2)(v): As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e).   a) Anna MS Inc., at a jobsite located on Belcher Court, Columbus, OH 43224: On and/or preceding March April 8, 2020, the employer did not ensure that employees harnesses, were connected by a lanyard to an anchor point in the basket, while working from an aerial lift. Two employees were working from the elevated basket of an aerial lift without any means of fall protection, thereby being exposed to an 18-foot fall hazard.
