29 CFR 1926.20(b)(1): The employer did not initiate and maintain accident prevention programs as necessary to comply with this part:  a) Carlos Hernandez located at 1125 Lyndale Drive, Westerville, OH 43081: On and preceding April 9, 2020, employees were installing sheathing and weather seal on a re-roof project of on a two story residential home at heights up to 20 feet without fall protection, an improperly configured ladder and no programs in place to maintain accident prevention at the site. The employer did not initiate and maintain safety and health programs related to the roofing work being conducted.

29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:  a) Carlos Hernandez located at 1125 Lyndale Drive, Westerville, OH 43081: On and preceding April 9, 2020, the employer did not instruct employees in the recognition and avoidance of unsafe conditions and the procedures to be followed in order to minimize these hazards. Roofers were installing sheathing and weather seal on a roof that varied from 10-20 feet without training in the recognition and avoidance of unsafe conditions at the site. The employees were not utilizing fall protection and using an improperly configured ladder which exposed them to falls up to 20 feet.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):    a) Carlos Hernandez located at 1125 Lyndale Drive, Westerville, OH 43081: On and preceding April 9, 2020, the employer did not ensure that employees engaged in residential construction activities 6 feet or more above lower level were protected from falls. Roofers were installing sheathing and weather seal on a roof that varied from 10-20 feet. The employees were not utilizing fall protection which exposed them to falls up to 20 feet.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  a) Carlos Hernandez located at 1125 Lyndale Drive, Westerville, OH 43081: On and preceding April 9, 2020, the employer did not ensure that the portable extension ladder used to gain access to the roof extended at least three feet beyond the upper landing that they were using for access.  An extension ladder used to gain access to roof section 10-11 feet high was positioned 12 inches beyond the eave of the roof.  The following condition exposed employees to falls up to 11 feet.
