29 CFR 1910.134(f)(2): The employer shall ensure that an employee using a tight-fitting facepiece respirator is fit tested prior to initial use of the respirator, whenever a different respirator facepiece (size, style, model or make) is used, and at least annually thereafter. (a) ICUs, 3 Pavilion East, 5 Pavilion East: Employees working as Respiratory Therapists were required to wear N95 filtering facepiece respirators while providing direct patient care to COVID-19 positive patients. The employer did not ensure the employees received annual fit tests, on and after 4/29/2020. (b) ICUs, 3 Pavilion East, 5 Pavilion East: Employees working as Respiratory Therapists were required to wear N95 filtering facepiece respirators while providing direct patient care to COVID-19 positive patients. The employer did not ensure that these employees were provided additional fit tests when different makes/models of N95 filtering facepiece respirators were used, on and after 4/29/2020.

29 CFR 1910.134(k)(1)(iv): The employer did not ensure that each user could demonstrate knowledge of how to inspect, put on, remove, use, and check the seals of the respirator: (a) ICUs, 3 Pavilion East, 5 Pavilion East: Employees working as Respiratory Therapists are required to wear N95 filtering facepiece respirators while providing direct care to COVID-19 positive patients.
