This was demonstrated when workers were observed working with a pneumatic nail gun without the use of personal eye protection.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:   At a worksite located at 619 and 621 E 101st Terr, Kansas City, MO: Employees were exposed to a fall hazards. This was demonstrated when workers were observed working at heights of approximately 7 and 15 feet without the use of fall protection, to include, guardrail systems, safety net systems, or personal fall arrest systems.

29 CFR 1926.502(d)(16)(ii): 29 CFR 1926.502 (d)(16)(ii): Personal fall arrest systems, when stopping a fall, did not limit the maximum arresting force on an employee to 1800 pounds (8kn) when used with a body harness:   At a worksite located at 619 and 621 E 101st Terr, Kansas City, MO: Employees were exposed to a fall hazards. This was demonstrated when workers were observed working at heights of approximately 8 feet with the use of fall protection, but whose rigging would not have reduced the arresting forces due to a lack of a lanyard in conjunction with the anchor rope being attached to the harness.

This was demonstrated when workers were observed working at heights of approximately 8 feet with the use of fall protection, but whose rigging would not be prevented them from striking the ground if they fell due to the rope grab being at or near the rope end.

This was demonstrated when workers were observed working at heights of approximately 8 feet with the use of fall protection, but whose lanyards were knotted reducing the effectiveness of the lanyard. The employer did not inspect the harness for any defective components prior to use.
