29 CFR 1926.501(b)(4)(i): Each employee on walking/working surfaces was not protected from falling through holes (including skylights), more than six feet (1.8 m) above lower levels, by personal fall arrest systems, covers, or guardrail systems erected around such holes:  On or about April 15, 2020, inside the bowl of the 250,000-gallon multi-column elevated water storage tank, the employer did not ensure employees working within the tank bowl were protected from falling more than 6-feet through the riser pipe hole to the lower surface below.

29 CFR 1926.1204(c)(1): The employer did not develop and implement the means, procedures, and practices necessary for safe permit space entry operations by specifying acceptable entry conditions:   On or about April 15, 2020, inside the riser of the 250,000-gallon multi-column elevated water storage tank, employees performed work inside a water tank which was a permit required confined space, and the employer did not perform initial and continuous air monitoring. Employees were exposed to hazards associated with respirable dust and chemical vapors:    a) Inside the bowl/tank where employees were sandblasting and blowing sand.   b) Inside the riser where employees were rolling/painting welds and sharp edges.

29 CFR 1926.1204(f): An attendant was not provided outside a permit confined space for the duration of entry operations:  On April 15, 2020, at the 250,000-gallon multi-column elevated water storage tank, employees who entered were not protected from tank entry hazards because an observer equipped to provide assistance in an emergency, was not always stationed outside the tank entered by employees.  a) Inside the bowl/tank where employees were sandblasting and blowing sand.  b) Inside the riser where employees were rolling/painting welds and sharp edges.
