29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: (a) New townhome construction located on Lot #26 Birchmore Drive, Sandy Springs, GA, Second level: On or about 04/17/2020, and at times prior, the employer exposed employees to fall hazards of up to 25-feet to the lower level, in that a fall protection system was not provided to employees engaged in framing activities.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: (a) New townhome construction located on Lot #26 Birchmore Drive, Sandy Springs, GA, Front side: On or about 04/17/20, and at times prior, the employer exposed employees to falls of approximately 20-feet to the lower level, in that the ladder used to access the second level was not extended at least 3-feet past to allow safe access on and off the second floor during framing activities.

(a) New townhome construction located on Lot #26 Birchmore Drive, Sandy Springs, GA, Front side: On or about 04/17/20, and at times prior, the employer exposed employees to falls of up to 20-feet while accessing the second level, in that the ladder was erected at a shallow angle of 56-degrees and not used as required by the manufacturer exposing employees to possible collapse and fall hazards during use.
