29 CFR 1910.134(c)(1): The employer did not establish and implement a written respiratory protection program with worksite-specific procedures for required respirator use, to reflect changes in workplace conditions that affect respirator use.  a) On or about April 20, 2020, at the Rehabilitation Center, a respiratory protection program had not been developed and implemented for employees required  to wear N-95 respirators, exposing employees to a respiratory illness such as but not limited to contracting SARS-CoV-2 the virus that causes COVID-19. Employees performed aerosol generating procedures such as, but not limited to, nebulizer treatments on patients.

29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:  a) On or about April 20, 2020 and times before thereto, at the Rehabilitation Center, employees required to wear N-95 respirators were not medically evaluated to determine their ability to wear a respirator by a physician or other licensed health care professional, exposing employees who may had underlying respiratory health conditions to exacerbate medical conditions.

29 CFR 1910.134(f)(1): The employer did not ensure that employee(s) required to use a tight-fitting facepiece respirator passed the appropriate qualitative fit test (QLFT) or quantitative fit test (QNFT):  a) On or about April 20, 2020 and times before thereto, at the Rehabilitation Center, employees required to wear tight fitting N-95 respirators were not provided with a qualitative or quantitative fit test, exposing employees to a respiratory illness such as but not limited to contracting SARS-CoV-2, the virus that causes COVID-19. Employees performed aerosol generating procedures such as, but not limited to, nebulizer treatments on patients.
