29 CFR 1910.30(a)(3):   The employer did not train each employee in at least the following topics: The nature of the fall hazards in the work area and how to recognize them; the procedures to be followed to minimize those hazards; the correct procedures for installing, inspecting, operating, maintaining, and disassembling the personal fall protection systems that the employee uses; and the correct use of personal fall protection systems and equipment specified in paragraph (a)(1) of this section, including, but not limited to, proper hook-up, anchoring, and tie-off techniques, and methods of equipment inspection and storage, as specified by the manufacturer.    a)  On Board the USNS Red Cloud in Bayonne Dry Dock, Bayonne, NJ  Employees tasked with inspecting and painting an anchor chain locker were exposed to a falling   approximately 33 feet to the base of the chain locker below. The employer did not provide training or instruction on fall hazards in the work area and the recognition and control of these hazards.               Violation observed on or about 04/19/2020.

29 CFR 1915.77(c):   When employees are working aloft, or elsewhere at elevations more than 5 feet above a solid surface, the employer did not provide either scaffolds or a sloping ladder, meeting the requirements of this subpart, to afford safe footing, and the employees were not protected by safety belts and lifelines meeting the requirements of 1915.159 and 1915.160:   a)  On Board the USNS Red Cloud in Bayonne Dry Dock, Bayonne, NJ.  Employees tasked with inspecting and painting an anchor chain locker were exposed to a fall of approximately 33 feet t to the base of the chain locker below while descending via half circle hand and foot holds in the chain locker's bulkhead wall. The employer did not provide a scaffold, a sloping ladder, nor fall protection.    Violation observed on or about 04/19/2020.

29 CFR 1915.87(c)(1):    The employer did not ensure that a first aid provider was able to reach an injured/ill employee within five (5) minutes of a report of a serious injury, illness, or accident such as one involving cardiac arrest, acute breathing problems, uncontrolled bleeding, suffocation, electrocution, or amputation.     a)  On Board the USNS Red Cloud in Bayonne Dry Dock, Bayonne, NJ.  An employees who fell (distance) not provided adequate emergency medical care. The employer did not ensure a first aid provider was able to reach an injured/ill employee within five (5) minutes of a report of a serious injury, illness, or accident. The employer did not take appropriate steps to ascertain that emergency medical assistance will be readily available promptly if an injury or illness occurs:    a) On Board the USNS Red Cloud in Bayonne Dry Dock, Bayonne, NJ.  Outside first aid providers to include Emergency Response Agencies and   Emergency Medical Services were not able to reach the worksite within (5) minutes of a worker fall incident resulting in a fatality.  The employer did not take appropriate steps to ascertain that emergency medical assistance will be readily available promptly if an injury or illness occurs. Employees tasked with inspecting and painting an anchor chain locker were exposed to a fall of approximately 33 feet in height to the base of the chain locker below while descending via half circle hand and foot holds in the chain locker's bulkhead wall. The employer did not conduct a hazard assessment to determine whether there were hazards present, which necessitate the employee's use of personal protective equipment to include personal fall arrest system necessary for  accessing a confined space. 29 CFR 1915.159(d):   Affected employees were not trained so that they could demonstrate the proper use, inspection, and storage of their fall arrest equipment.  a)  On Board the USNS Red Cloud in Bayonne Dry Dock, Bayonne, NJ and at the Corporate Offices at 331 River Mews Lane, Edgewater, NJ.  The foreman overseeing the laborers who were to inspect and paint an anchor chain locker was not provided training on fall arrest equipment as he rigged up a vertical rope lifeline at the chain locker with multiple knots at the anchorage point and along the course of the rope which weakened this lifeline exposing workers to fall hazards of up to 33 feet in height to the base of the chain locker below.                                                                      Violation observed on or about 04/19/2020.
