29 CFR 1910.134(a)(2): A respirator was not provided by the employer to each employee when such equipment was necessary to protect the health of the employee:  1515 Lamberts Mill Road Operations, LLC dba Westfield Center/Westfield, NJ - Throughout the nursing home:  a) On or about 3/30/2020 and thereafter, a recreational assistant helping residents during activities such as making phone calls, reading books, and playing games, was coming in close contact (within 6 feet) with residents suspected or confirmed as having COVID-19, without being provided a respirator applicable to and suitable for the purpose intended when such equipment was necessary to protect the health of such employee.      b) On or about 3/30/2020 and thereafter, a recreational director providing direct care to residents during activities such as books reading and games playing, was coming in close contact (within 6 feet) with residents suspected or confirmed as having COVID-19, without being provided a respirator applicable to and suitable for the purpose intended when such equipment was necessary to protect the health of such employee.       c) On or about 3/30/2020 and thereafter, employees including, but not limited to nurses, nurse supervisors, and nursing assistants, who provided direct care to residents, were coming in close contact (within 6 feet) with residents suspected or confirmed as having COVID-19, without being provided a respirator applicable and suitable for the purpose intended when such equipment was necessary to protect the health of such employees.
