29 CFR 1926.451(b)(1)(i): The employer did not ensure that each platform unit (e.g., scaffold plank, fabricated plank, fabricated deck, or fabricated platform) was installed so that the space between adjacent units and the space between the platform and the uprights is no more than 1 inch (2.5 cm) wide, except where the employer can demonstrate that a wider space is necessary. On or about April 21, 2020 and at times prior to, employees working on a multi-story apartment complex were exposed to falls of approximately 13 feet to the ground below. Scaffolds were not fully planked.

29 CFR 1926.451(c)(2): The employer did not ensure that supported scaffold poles, legs, posts, frames, and uprights were placed on base plates and mud sills or other adequate firm foundation. On or about April 21, 2020 and at times prior, employees working on a multi-story apartment complex were exposed to falls of approximately 13 feet to the ground below and being struck by collapsing scaffold parts. Scaffold legs were not equipped with mud sills to prevent penetration into ground causing the scaffold to collapse.

On or about April 21, 2020, employees working on a two story apartment complex were exposed to falls of approximately 13 feet to the ground below.
