29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:  a) At the Facility - 3025 Chapel Avenue West, Cherry Hill NJ:    On or about and after April 17, 2020 and thereafter, the employer provided and required employees, including but not limited to; Registered Nurses (RNs), Certified Nurse Assistants (CNAs), License Practical Nurses (LPNs) and housekeeping staff to wear N95 respirators while providing care and services to patients with presumed or confirmed COVID-19.  The employer did not develop and implement a written respiratory protection program.   ABATEMENT CERTIFICATION IS REQUIRED FOR THIS VIOLATION

29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace  a) At the facility - 3025 Chapel Avenue West, Cherry Hill NJ:  On or about August 17, 2020 and thereafter, the employer did not provide a medical evaluation to employees, including but not limited to Registered Nurses (RNs), Certified Nurse Assistants (CNAs), License Practical Nurses (LPNs) and housekeeping staff to determine the employees' ability to wear the N95 respirators.  These employees were providing care and services to patients with presumed or confirmed COVID-19.  Employees were provided with and required to wear N95 respirators. The employer did not provide a fit test to all employees required to wear respirators, including but not limited to Resisted Nurses (RNs), Certified Nurse Assistants (CNAs), Licensed Practical Nurses (LPNs), and housekeeping staff. 29 CFR 1904.4(a): The employer did not record each work-related fatality, injury or illness case that resulted in the general recording criteria on the OSHA Form 300 or equivalent.   a)  At the facility - 3025 Chapel Avenue West, Cherry Hill, NJ:  On April 16, 2020, BP&SC Services Inc.'s Director of Environmental Services of Housekeeping and Laundry tested positive for COVID-19.  The employer was aware of the diagnosis.  As of August 26, 2020, the host employer did not record the employee's illness in their OSHA 300 logs.    b) At the facility - 3025 Chapel Avenue West, Cherry Hill NJ:  On April 17, 2020, a Licensed Practical Nurse (LPN) tested positive for COVID-19.  The employer was aware of the diagnosis.  As of August 26, 2020, the employer did not record the employee's illness in their OSHA 300 logs.  c) At the facility - 3025 Chapel Avenue West, Cherry Hill NJ:  On or about April 17, 2020, a Certified Nurse Assistant (CNA) tested positive for COVID-19.  The employer was aware of the diagnosis.  As of August 26, 2020, the employer did not record the employee's illness in their OSHA 300 logs.  d) At the facility - 3025 Chapel Avenue West, Cherry Hill NJ:  On or about April 17, 2020, a Certified Nurse Assistant (CNA) had a COVID-19 positive result.  The employer was aware of the diagnosis.  As of August 26, 2020, the employer did not record the employee's illness in their OSHA 300 logs.  e) At the facility - 3025 Chapel Avenue West, Cherry Hill NJ:  On or about April 17, 2020, an Admissions worker tested positive for COVID-19.  The employer was aware of the diagnosis.  As of August 26, 2020, the employer did not record the employee's illness in their OSHA 300 logs.  f) At the facility - 3025 Chapel Avenue West, Cherry Hill NJ:  On April 26, 2020, an Assistant of the Director Of Nursing (ADON) tested positive for COVID-19.  The employer was aware of the diagnosis.  As of August 26, 2020, the employer did not record the employee's illness in their OSHA 300 logs.  g) At the facility - 3025 Chapel Avenue West, Cherry Hill NJ:  On May 26, 2020, an Activities worker tested positive for COVID-19.  The employer was aware of her diagnosis.  As of August 26, 2020, the employer did not record the employee's illness in their OSHA 300 logs.  ABATEMENT CERTIFICATION IS REQUIRED FOR THIS ITEM
