29 CFR 1926.1053(b)(4): Ladders shall be used only for the purpose for which they were designed.    On or about April 21, 2020 a non-self-supporting sectional fiberglass Werner Model D6232-2 extension ladder was used by employees for climbing or descending to a low-sloped roof to perform roofing associated roofing activities without using the ladder for the purpose for which it was designed by Werner Ladders in that the top section of sectional Warner Ladder Model D6232-2 extension ladder was used for a bottom section without the user equipping that section with safety shoes and that the Werner Ladder Model D6232-2 extension ladders footing support was utilized without safety shoes, spikes, spurs, slip resistant pads or similar devices being used exposing the employees climbing or descending to fall potentials in excess of 10 feet.      Werner Ladders Fiberglass Ladder Technical Manual Care, Use, and Quality Control of Reinforced Plastic ladders pages 15 and 16 identify under Use of Sections of Sectional Ladders the middle and top sections of sectional ladders shall not be used for bottom sections unless the user equips them with safety shoes. Under the heading Footing Support it identifies ladders without safety shoes, spikes, spurs, slip resistant pads or similar devices shall not be used.

29 CFR 1926.1053(b)(6): Ladders shall be used only on stable and level surfaces unless secured to prevent accidental displacement.    On or about April 21, 2020 a non-self-supporting sectional fiberglass Werner Model D6232-2 extension ladder was used by employees for climbing or descending to a low-sloped roof to perform roofing associated activities with the top section of the sectional Warner Ladder Model D6232-2 extension ladder being utilized as the bottom section without ensuring the ladder base or bottom section was secured from displacement or stable on its resting surface due to the base the surfaces that the unsecured bottom side rails sections notched plastic side rail end caps contact with the concrete surface created an unstable resting surface as utilized exposing the employees climbing or descending to fall potentials in excess of 10 feet.

29 CFR 1926.1053(b)(7): Ladders shall not be used on slippery surfaces unless secured or provided with slip-resistant feet to prevent accidental displacement. Slip-resistant feet shall not be used as a substitute for care in placing, lashing, or holding a ladder that is used upon slippery surfaces including, but not limited to, flat metal or concrete surfaces that are constructed so they cannot be prevented from becoming slippery.    On or about April 21, 2020 a non-self-supporting sectional fiberglass Werner Model D6232-2 extension ladder was used by employees for climbing or descending to a low-sloped roof to perform roofing associated activities with the utilized top section of the sectional Warner Ladder Model D6232-2 extension ladder side rails being placed against the roof parapet flashing creating a slippery surfaces between the resting side rails and roof parapet metal flashing without  holding or lashing the top area of the extension ladders side rails or rungs exposing the employees climbing or descending to fall potentials in excess of 10 feet.
