29 CFR 1910.134(f)(2): Employee(s) using tight-fitting facepiece respirators were not fit tested prior to initial use of the respirator, or annually refitted: ICU Unit, 1 Bay Street, Montclair, NJ, 07042 a) The employer required two intensive care unit (ICU) nurses and a certified nursing assistant to wear N95 respirators when providing care to patients, including those under investigation and/or confirmed as COVID-19 positive. However, the employer did not provide these employees with an initial fit test to ensure the respirator fit employees to protect them from exposure to SARS-CoV-2. b) The employer required two ICU nurses to wear N95 respirators when providing care to patients including those under investigation and/or confirmed as COVID-19 positive. However, the employer did not provide these employees with an annual fit test prior to March 2020 to ensure that the respirator fit them in order to protect them from exposure to SARS-CoV-2. Violation occurred on or about 4/23/2020 and thereafter.
