OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards:    (a) On or about 4/22/2020 and at times prior - Onsite Truck Repair and Equipment Repair Shops, Technicians and Helpers working on tractor trailers, trailer vans, tankers, and flatbeds, were not protected from falling approximately four feet from the working surface to the ground below.

29 CFR 1910.28(b)(1)(i): The employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that was 4 feet (1.2 m) or more above a lower level was protected from falling by one or more of the following: guardrail systems; safety net systems; or personal fall protection systems, such as personal fall arrest, travel restraint, or positioning systems:    (a) On or about 4/22/2020 - Southern side of trailer yard and west of main office (a.k.a. "the hill"), employees were exposed to falls of approximately 80 inches (6' 8") to a hard packed dirt and gravel surface with obstacles in between when they worked from the top of the engine compartment of a CAT Model 320B Excavator to replace the alternator without fall protection.

"the hill"), employees were exposed to falls of approximately 80 inches (6' 8") to a hard packed dirt and gravel surface when they worked from the top of the engine compartment of a CAT Model 320B Excavator to replace the alternator and had not received fall protection training prior to performing such work.
