29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 8-9 feet and above lower levels was not protected by personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure:  a)  Martinez Construction, LLC, 4318 E. Utah Place, Denver, CO  80222:  On and before April 23, 2020, the creating, exposing, and correcting employer did not ensure that employees were protected from injury, in that two employees reframing on the first level worked near the edge of the building without utilizing a fall protection system.  This condition exposed the employees to a fall hazard of approximately 8-9 feet.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee who might be exposed to fall hazards. There was no program to enable each employee to recognize the hazards of falling and to train each employee in the procedures to be followed in order to minimize these hazards:  a)  Martinez Construction, LLC, 4318 E. Utah Place, Denver, CO  80222:  On and before April 23, 2020, the employer did not provide a training program for each employee who might be exposed to fall hazards while framing. There was no program to enable each employee to recognize the hazards of falling and to train each employee in the procedures to be followed in order to minimize these hazards.  This condition exposed employees to fall hazards.

29 CFR 1926.416(a)(1): The employer permitted employees to work in close proximity to any part of an electric power circuit that the employee could contact the electric power circuit in the course of work and the employees were not protected against electric shock by deenergizing the circuit and grounding it or by guarding it effectively by insulation or other means:  a)  Martinez Construction, LLC, 4318 E. Utah Place, Denver, CO  80222:  On and before April 23, 2020, the employer permitted employees to work within 10 feet of a live and at least 240V incoming transponder on the southwest corner of a house.  Employees were contracted to perform fire mitigation services and were not protected against electric shock by deenergizing the circuit and grounding it or by guarding it effectively by insulation or other means.  This condition exposed employees to electrical hazards.

This condition exposed employees to head hazards.
