29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  a) Commercial buildings (Suites 100 & 200) located at 4385 Kimball Bridge Road, Johns Creek, GA, front parking lot: On or about 04/24/2020, the employer exposed employees to struck-by hazards while removing roofing debris, in that employees working below employees engaged in roofing work directly above were not provided with head protection.

29 CFR 1926.552(a)(1): The employer did not comply with the manufacturer's specifications and limitations applicable to the operation of all hoists and elevators.                                                                   a) Commercial Building (Suite 200) located at 4385 Kimball Bridge Road, Johns Creek, GA: Front side: On or about 04/24/2020, the employer allowed employees to use the material hoist as a ladder to access the roof exposing them to fall hazards of approximately 3-feet, in that the manufacturer states in the general safety instructions not to climb the LH-Series hoist or use as a personnel ladder.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  a) Commercial building (Suite 100) located at 4385 Kimball Bridge Road, Johns Creek, GA, Front side: On or about 04/24/2020, the employer exposed employees to falls of 13-feet, 6-inches to the lower level, in that the ladders used to access the roof were not extended at least 3-feet or secured to the structure to prevent movement during use.

29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles.  a) Commercial building (Suite 100) located at 4385 Kimball Bridge Road, Johns Creek, GA, Roof: On or about 04/24/2020, the employer exposed employees to struck-by hazards while operating pneumatic roofing nail guns, in that protective eyewear was provided but not used by the both roofers engaged in new shingle installation on building 100.    Luis Liborie Nazario was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.102(a)(1), which was contained in OSHA inspection number 1269932, citation number 1, item number 1 and was affirmed as a final order on 11/13/2017, with respect to a workplace located at 210 Grace Street, Oxford, AL.

29 CFR 1926.501(b)(11): Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels was not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems:  a) Commercial buildings (Suites 100 & 200) located at 4385 Kimball Bridge Road, Johns Creek, GA: Roof: On or about 04/24/2020 the employer exposed employees to fall hazards of 13-feet, 6-inches to the lower level, in that employees engaged in roof tear off and underlayment installation activities on a 10/12 pitched roof were not provided with a fall protection system.   Luis Liborie Nazaro was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(10), which was contained in OSHA inspection number 1269932, citation number 1, item number 2(a) and was affirmed as a final order on 11/13/2017, with respect to a workplace located at 210 Grace Street, Oxford, AL.
