29 CFR 1926.501(b)(11): Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels was not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems: (a)Mikes Roofing, Inc., at 408 South Western Avenue, Hartford, SD 57033: On or about and at times prior to April 27, 2020, the employer did not ensure that each employee engaged in re-roofing operations on a commercial building were protected from injury in that, employees were re-roofing without using a fall protection system while exposed to fall hazards. This condition exposed two employees to fall hazards of 12 foot or greater to the concrete below.

29 CFR 1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system: (a)Mikes Roofing, Inc., at 408 South Western Avenue, Hartford, SD 57033: On or about and at times prior to April 27, 2020, the employer did not ensure employees were protected from falls on a flat roof having an unprotected side or edge which was six feet or more above a lower level. Employees were working in close proximity to the edge of flat roof while transferring materials and equipment to conduct re-roofing activities on a steeped pitch roof. This condition exposed employees to a fall hazard of approximately 12 feet.
