OSH ACT of 1970 Section (S)(a)(l): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees from the hazard of being struck-by.        On or about 28 April 2020, and at times prior thereto, employees engaged in guiding steel arch sections with a forklift were exposed to the hazard of struck-by.  a) While raising the arch upright, ironworkers were either under the load or near the ends without tethers.    b) A single fiber web sling was attached to the arch on one section, creating an off-centered, unstable load.
