OSH ACT of 1970 Section (S)(a)(l): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees from the hazard of being struck-by. On or about 28 April 2020, and at times prior thereto, employees engaged in guiding steel arch sections with a forklift were exposed to the hazard of struck-by. a) While raising the arch upright, ironworkers were either under the load or near the ends without tethers. b) A single fiber web sling was attached to the arch on one section, creating an off-centered, unstable load.

29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l). On or about 28 April 2020, and at times prior thereto, an employee was operating a JLG 1255 Telehandler Forklift without being trained, evaluated, and certified to operate the machine, exposing the employee and those nearby to the hazard of being struck by the forklift.

29 CFR 1926.602(c)(1)(ii): Modifications or additions which affect the capacity or safe operation of the equipment were made without the manufacturer's written approval. On or about 28 April 2020, and at times prior thereto, a telehandler forklift was used to lift upright a newly welded steel arch consisting of two curved hollow steel sections as the first piece for a dome in which the ironworkers were exposed to the hazard of being struck by one or both of the arch sections. To raise the arch, a fiber web sling was attached to one fork of the forklift in the manner of free rigging without prior written approval from the manufacturer.
