29 CFR 1926.20(b)(1): The employer did not initiate and maintain accident prevention programs as necessary to comply with this part:  a) Roofing by M and M located at 215 N. Court Street, Circleville, OH:  On and preceding May 4, 2020, employees were installing sheathing and other materials on a re-roof project of on a three story commercial building.  Roofers were working at heights exceeding 30 feet without fall protection, PPE and no programs in place to maintain accident prevention at the site. The employer did not initiate and maintain safety and health programs related to the roofing work being conducted.

29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:  a) Roofing by M and M located at 215 N. Court Street, Circleville, OH:  On and preceding May 4, 2020, the employer did not instruct employees in the recognition and avoidance of unsafe conditions and the procedures to be followed in order to minimize these hazards. Roofers were installing sheathing and other materials on a re-roof project of on a three story commercial building at heights exceeding 30 feet without fall protection or PPE used which exposed them to fall and struck-by hazards.

29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  a) Roofing by M and M located at 215 N. Court Street, Circleville, OH:  On and preceding May 4, 2020, the employer did not ensure that employees wore eye protection while utilizing and electric circular saw. Workers were cutting plywood sheets to size using a circular saw without the use of eye protection.  The following condition exposed employees to struck-by hazards to the eyes.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  a) Roofing by M and M located at 215 N. Court Street, Circleville, OH:  On and preceding May 4, 2020, the employer did not ensure that employees engaged in construction activities 6 feet or more above lower level were protected from falls.  Roofers were installing sheathing and other materials on a re-roof project of on a three story commercial building at heights exceeding 30 feet without fall protection. The following condition exposed the workers to falls exceeding 30 feet.
