29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  a) 1st Rate Construction, LLC located at 1463 Berkshire Rd. Upper Arlington, OH 43220:  On and preceding May 6, 2020, the employer did not ensure employees wore safety glasses while utilizing power tools that presented struck-by hazards to the eyes and face. Framers were installing wood decking and other framing pieces using a pneumatic nail gun. The employees were not utilizing eye protection which exposed them to struck-by hazards to the eyes.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a) 1st Rate Construction, LLC located at 1463 Berkshire Rd. Upper Arlington, OH 43220:  On and preceding May 6, 2020, the employer did not ensure that employees engaged in residential construction activities 6 feet or more above lower level were protected from falls. Framers were installing wood decking and other framing pieces on top of the second floor at heights up to 11 feet. The employees were not utilizing any form of fall protection which exposed them to falls up to 11 feet.

29 CFR 1926.1053(b)(1): Where (a) portable ladder(s) was/were used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder.   a) 1st Rate Construction, LLC located at 1463 Berkshire Rd. Upper Arlington, OH 43220:  On and preceding May 6, 2020, the employer did not ensure that the portable ladder used to gain access to the roof and exterior walls extended at least three feet beyond the upper landing that they were accessing.  Framers were utilizing a self-supporting ladder to access the second floor of a two story residential home which was positioned below the upper landing they were accessing or secured with a grasping device.  The following condition exposed employees to falls up to 10 feet.
