29 CFR 1926.20(b)(1): It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part. a. Located at 2928 Berlin Manor (lot#2252), Delaware, Ohio: On or about May 06, 2020, the employer did not initiate and maintain a safety and health program to ensure hazard detection and correction, while employees performed sheathing work onsite. Two employees were unprotected on the roof top of the second level of a new build residential home. The fall distance was approximately 24 feet from the eave and rafters to the ground level.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. a. Located at 2928 Berlin Manor (lot#2252), Delaware, Ohio: On or about May 06, 2020, the employer failed to ensure that two employees who worked from the roof top of the second floor level of a new build residential home were protected while they installed OSB sheathing. The employees were exposed to a fall hazard of approximately 24 feet, from the unprotected side and edge near the eave of the roof top.
