OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to engulfment hazards:  The employer is failing to prevent employee from exposure to engulfment hazards during grain bin activities.  The condition was most recently observed on about on or about May 5th, 2020 at a silo located at 8702 Highway B in Palmyra, MO.  Employees regularly entered grain silos/bins to check the condition and level off grain.

OSH ACT of 1970 Section (5)(a)(1):   The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that the employees were exposed to electrical hazards.  The employer is failing to prevent employee exposure to contact with electrical energy.  The condition was most recently observed on about on or about May 5th, 2020 at a silo located at 8702 Highway B in Palmyra, MO. The employees were exposed to the following electrical hazards:   a) A junction box and on the rear of the structure and a 220 VAC receptacle near the door on a silo located at 8702 Highway B in Palmyra, MO was not designed for outdoor use.   b)  Unused openings in cabinets, boxes, and fittings were not effectively closed.  A junction box on a silo, located at 8702 Highway B in Palmyra, MO, had unused openings and was missing a cover, exposing employees to live electrical parts.  c)  All pull boxes, junction boxes, and fittings were not provided with covers identified for the purpose.  A junction box on a silo, located at 8702 Highway B in Palmyra, MO, was not provided with a cover/markings identified for the purpose.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training to be met: (Agriculture Reference: 1928.21(a)(5):    The employer is failing to prevent employee exposure to contact with hazardous chemicals through implementation of a hazard communication program.  The condition was most recently observed on about on or about May 5th, 2020 at a silo located at 8702 Highway B in Palmyra, MO on or about May 5th, 2020.  Randall E. Klocke Farm, had not developed and maintained a written hazard communication program.  Employees routinely used various pesticides, herbicides, and fungicides.

Klocke Farm had not provided instructions to facilitate lock out of electrical power before performing maintenance or service on farmstead equipment.

29 CFR 1928.57(c)(2)(i): The mesh or nip-points of all power driven gears, belts, chains, sheaves, pulleys, sprockets, and idlers were not guarded.  The employer is failing to prevent employee exposure to struck-by and caught-in-between hazardous.  The condition was most recently observed on about on or about May 5th, 2020 at a silo located at 8702 Highway B in Palmyra, MO.  Randall E. Klocke Farm had not ensured one or more methods of machine guarding were provided to protect the operator and other employees in the machine area from hazards such as those created by ingoing mesh or nip points. A motor and auger used to remove grain from a 42 foot diameter silo did not have the pulleys and belt guarded.
