29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1920.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:  On or about May 6, 2020, through June 1, 2020, employees were required to wear N95 filtering facepiece respirators for protection from exposure to the SARS-CoV-2 virus, when performing tasks such as, but not limited to, feeding, bathing, maintaining continence, inserting and maintaining IV�s, and conducting assessments for suspected or confirmed COVID-19 positive residents.  The employer did not establish and implement a written respiratory protection program with worksite specific procedures, including the provisions defined in 29 CFR 1910.134(c)(1)(i) - (ix).   Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d).

29 CFR 1910.134(e)(1): General. The employer shall provide a medical evaluation to determine the employee's ability to use a respirator, before the employee is fit tested or required to use the respirator in the workplace. The employer may discontinue an employee's medical evaluations when the employee is no longer required to use a respirator.  On or about May 6, 2020, through June 1, 2020, employees were required to wear N95 filtering facepiece respirators for protection from exposure to the SARS-CoV-2 virus, when performing tasks such as, but not limited to, feeding, bathing, maintaining continence, inserting and maintaining IV�s, and conducting assessments for suspected or confirmed COVID-19 positive residents.
