On or about May 6, 2020, the employer did not to install a fall protection system before employees began work on a residential roof structure and exposing employees to a 9 foot 5 inch, 9 foot 7 inch, 16 foot 3 inch, and 19 foot 4 inch fall hazard.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. a.) On or about May 6, 2020, employees were exposed to fall hazards measured to be 9 foot 5 inches, 9 foot 7 inches, 16 foot 3 inches, and 19 foot 4 inches while removing asphalt shingles on a residential roof without properly utilizing a fall protection system. The employer, Vidal Cardenas, was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1430196, citation number 1, item number 1b and was affirmed as a final order on 12/11/2019, with respect to a workplace located at 3431 Hamilton-Middletown Road Hamilton, OH 45011

On or about May 6, 2020, employees were not trained to recognize fall hazards such as, but not limited to, 9 foot 5 inch, 9 foot 7 inch, 16 foot 3 inch, and 19 foot 4 inch fall hazards while removing asphalt shingles on a pitched roof, nor were they trained on when to utilize a fall protection system. The employer, Vidal Cardenas, was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.503(a)(1), which was contained in OSHA inspection number 1430196, citation number 1, item number 1b and was affirmed as a final order on 12/11/2019, with respect to a workplace located at 3431 Hamilton-Middletown Road Hamilton, OH 45011
