29 CFR 1926.20(b)(1): It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.  a) Alejandro Cruz Gutierrez, at a jobsite located at 1245 Babbling Brook, Galena, OH 43021: On and/or preceding May 7, 2020, the employer failed to initiate and maintain a safety and health program such as but not limited to a personal protective equipment program, an electrical safety program, and a fall protection program for employees conducting framing work.

29 CFR 1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury.  a) Alejandro Cruz Gutierrez, at a jobsite located at 1245 Babbling Brook, Galena, OH 43021: On and/or preceding May 7, 2020, the employer failed to train employees on the common hazards found in residential construction or the regulations required to control or eliminate the hazards. Employees conducting framing work were exposed to struck-by hazards, fall hazards, and electrical contact hazards.

29 CFR 1926.102(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.   a) Alejandro Cruz Gutierrez, at a jobsite located at 1245 Babbling Brook, Galena, OH 43021: On and/or preceding May 7, 2020, the employer did not ensure employees wore safety glasses while utilizing power tools that presented struck-by hazards to the eyes and face. Carpenters were installing framing while using a powered nail gun. The employees were not utilizing eye protection, which exposed them to struck-by hazards to the eyes.

The path to ground from circuits, equipment, and enclosures shall be permanent and continuous.  a) Alejandro Cruz Gutierrez, at a jobsite located at 1245 Babbling Brook, Galena, OH 43021: On and/or preceding May 7, 2020, the employer did not ensure employees who used extension cords were protected from electrical contact hazards. Framers were using an extension cord with the ground prong missing from the male end of the cord, which exposed the employees to a 125 volt electrical contact hazard.

Flexible cords shall be connected to devices and fittings so that strain relief is provided which will prevent pull from being directly transmitted to joints or terminal screws.  a) Alejandro Cruz Gutierrez, at a jobsite located at 1245 Babbling Brook, Galena, OH 43021: On and/or preceding May 7, 2020, the employer did not ensure that the strain relief was connected to the jacket of the cord. Framers were using an extension cord with the strain relief section of the plug pulled away from the jacket of the cord, which exposed the employees to a 125 volt electrical contact hazard.

Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.    a) Alejandro Cruz Gutierrez, at a jobsite located at 1245 Babbling Brook, Galena, OH 43021: On and/or preceding May 7, 2020, the employer did not ensure employees were protected from falls while engaged in residential construction activities. Employees were framing in the second story roof without any means of fall protection, thereby exposed to fall hazards of up to 30 feet.  b) Alejandro Cruz Gutierrez, at a jobsite located at 1245 Babbling Brook, Galena, OH 43021: On and/or preceding May 7, 2020, the employer did not ensure employees were protected from falls while engaged in residential construction activities. Employees were working on the first floor where the stairway opening to the basement was unguarded, thereby exposed to fall hazards of 10 feet.
