29 CFR 1926.100(a): Employees working in areas where there is a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, shall be protected by protective helmets.   a) MA Diaz Construction, LLC, at a jobsite located at 833-869 Hidden Springs Drive, Lewis Center, Ohio 43035: On and/or preceding May 7, 2020, the employer failed ensure employees wore head protection while exposed to a head injury from impact from falling or flying objects. Employees were working at ground level while other employees were installing sheathing to the second story while using powered nail guns, circular saws, and hand tools. The employees were not utilizing head protection, which exposed them to struck-by hazards.

Carpenters were installing framing while using a pneumatic nail gun. The employees were not utilizing eye protection, which exposed them to struck-by hazards to the eyes.

The path to ground from circuits, equipment, and enclosures shall be permanent and continuous.   a) MA Diaz Construction, LLC, at a jobsite located at 833-869 Hidden Springs Drive, Lewis Center, Ohio 43035: On and/or preceding May 7, 2020, the employer did not ensure employees who used extension cords were protected from electrical contact hazards. Framers were using an extension cord with the ground prong missing from the male end of the cord at the temporary electrical panel, used to provide power to a distribution block, which exposed the employees to a 125 volt electrical contact hazard.  b) MA Diaz Construction, LLC, at a jobsite located at 833-869 Hidden Springs Drive, Lewis Center, Ohio 43035: On and/or preceding May 7, 2020, the employer did not ensure employees who used extension cords were protected from electrical contact hazards. Framers were using an extension cord with the ground prong missing from the male end of the cord, used to provide electrical power to a circular saw, which exposed the employees to a 125 volt electrical contact hazard.

Employees were using an extension cord with the outer insulation jacket pulled away from the strain relief of the male end of the cord, thereby exposing employees to a 125 volt electrical contact hazard.

29 CFR 1926.1053(b)(1): When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support.   a) MA Diaz Construction, LLC, at a jobsite located at 833-869 Hidden Springs Drive, Lewis Center, Ohio 43035: On and/or preceding May 7, 2020, the employer did not ensure portable ladders that were used for access to an upper landing surface were extended at least 3 feet (.9 m) above the upper landing surface. Employees were using an extension ladder that was not at least 3 feet above the second story floor, thereby exposed to fall hazards of up to 10 feet 4 inches.

Employees were sheathing the second story floor without any means of fall protection, thereby exposed to fall hazards of up to 10 feet 4 inches.  a) MA Diaz Construction, LLC, at a jobsite located at 833-869 Hidden Springs Drive, Lewis Center, Ohio 43035: On and/or preceding May 7, 2020, the employer did not ensure employees were protected from falls while engaged in residential construction activities. Employees were framing the second story floor without any means of fall protection, thereby exposed to fall hazards of up to 10 feet 4 inches.  MA Diaz Construction, LLC was previously cited for a Repeat violation of this occupational safety and health standard, which was contained in OSHA inspection number 1008171, citation number 1, item number 1, and was affirmed as a final order on April 10, 2018, with respect to a workplace located at 2445 W. Dublin Granville Rd Unit 42, Worthington, OH 43085.
