Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to struck-by hazards: This violation occurred on or about May 6, 2020, an employee was operating a sheeps foot roller/compactor on a steep unstable slope without wearing a seatbelt. This exposed the employee to a struck-by hazard.

29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury. This violation occurred on or about May 6, 2020, the employer did not ensure that employees were adequately trained to recognize the hazards associated with the operation of the sheeps foot roller/compactor to ensure the safe operation of the equipment. This exposed the employees to struck-by and caught-in hazards.

This violation occurred on or about May 6, 2020, and at times prior thereto, at the jobsite, the employer did not provide employees with working toilet facilities when working in very remote road construction worksites.
