29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them): (a) Scott Elliott Services LLC, at 10150 E Virginia Avenue, Building 18, Denver, CO: On and preceding 5/8/2020, the employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them). Scott Elliott Services LLC directed the work of contractor David Morse, during repairs to balconies at the Oak Park Condominiums. Scott Elliott Services LLC did not ensure that the work site was inspected frequently and regularly by a competent person. This condition exposed employees of David Morse to approximate 7.7 foot and fourteen foot fall hazards.
