29 CFR 1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury:  a) Jobsite located at 400 Charles Ellis Drive, Newtown Square, PA: The employer failed to instruct employees who were working in an unprotected excavation approximately 5-10 foot deep on the recognition and avoidance of hazards such as but not limited to, struck-by, caught in-between, and tripping hazards.  Condition was observed on or about 14 MAY 2020.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c):  a) Jobsite located at 400 Charles Ellis Drive, Newtown Square, PA: The employer did not ensure that a protective system was installed inside an excavation measuring approximately 10 feet deep by 10 feet length and 8 feet wide, thus exposing employees inside the excavation to caught-in between and struck-by hazards.  Condition was observed on or about 14 MAY 2020.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems:  a) Jobsite located at 400 Charles Ellis Drive, Newtown Square, PA: The employer failed to ensure at least daily that a competent person inspected excavations for situations that could result in cave-ins.  Employees were permitted to work in an unprotected excavation measuring approximately 10 feet deep by 10 feet length and 8 feet wide that was not inspected by a competent person.  Condition was observed on or about 14 MAY 2020.  Manchester Construction, Inc., was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.651(k)(1) which was contained in OSHA inspection number 1226943, citation number 1, item number 2 and was affirmed as a final order on 24 JUN 2017, with respect to a workplace located at Lot 32 High Pointe, Delaware City, DE. 19720.
