29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary. At a jobsite located on Creekside Drive, Parkville, Missouri 64152, An employee working in a twelve (12) foot excavation was exposed to serious struck by and or engulfment hazards. a. The spoil pile for the excavation was not placed at least two (2) feet back from the edge of the excavation. b. A Komatsu PC 360 LC excavator was not kept at least two (2) feet back from the edge of the excavation.
