29 CFR 1296.405(b)(1): Unused openings in cabinets, boxes, and fittings were not effectively closed: a) Several circuit breaker cabinets in the cellar had unprotected openings where breakers had been removed; employees are exposed to electric shock hazard during gut renovation construction activities. Location: 16 2nd Place, Brooklyn NY On or about 3/10/2020 NOTE: BECAUSE ABATEMENT OF THIS VIOLATION IS ALREADY DOCUMENTED IN THE CASEFILE, THE EMPLOYER NEED NOT SUBMIT CERTIFICATION NOR DOCUMENTATION OF ABATEMENT OF THIS VIOLATION AS NORMALLY REQUIRED BY 29 CFR 1903.19.

29 CFR 1926.1053(b)(1): When portable ladders were used for access to an upper landing surface, the ladder side rails did not extend at least three feet above the upper landing surface; or, when such an extension is not possible because of the ladder's length, the ladder was not secured at its top to a rigid support that will not deflect, and a grasping device such as a grab-rail was not provided: a) The 10 ft A-frame stepladder being used to reach the 12 ft high roof hatch and was too short and was not secured. Employees were exposed to unsafe ladder fall hazard during gut renovation construction activities.
