On or about May 18, 2020 one employee was operating an aerial lift to install fascia on the roof section of a 4 story residential structure and was not wearing a body belt or personal fall protection with a lanyard attached to the working basket of the aerial lift exposing him to a 47 foot fall hazard.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): The employer fails to assure effective protection against falls as required by the standard, as demonstrated on May 18, 2020, when employees are installing roof sheathing, on a 4 story multi unit, residential dwelling at 1310 Tomoka Town Center, Daytona Beach, FL 32114, without fall protection and are exposed to falls of approximately 48-feet, 4-inches to the ground below. Reyes Y Reyes Construction, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13):, which was contained in OSHA inspection number 1432692, citation number 1, item number 1, and was affirmed as a final order on January, 24, 2020, with respect to a workplace located at 8283 Baymeadows Road, Jacksonville, FL 32256.
