29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: The employer failed to provide medical evaluations for employees who were required to wear N95 respirators. On or about May 15, 2020 and thereafter, the employer did not provide medical evaluations prior to the required use of N95 respirators. Staff wore N95 respirators when performing duties on the COVID-19 resident isolation halls.
