29 CFR 1926.20(b)(1): It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.  a. Located at 7367 Yarrow Run Road (Lot# 1384), Plain City, Ohio: On or about May 20, 2020, the employer did not initiate and maintain a safety and health program to ensure hazard detection and correction, while employees performed framing work onsite.  Three employees worked unprotected on top of the second floor roof top as they installed the OSB sheathing to the high pitched roof.  The fall distance was approximately 20 feet from the roof top eave to the ground level.

29 CFR 1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury.  a. Located at 7367 Yarrow Run Road (Lot# 1384), Plain City, Ohio: On or about May 20, 2020, the employer failed to instruct employees on the avoidance of unsafe conditions, while they performed framing work at a new build residential construction worksite.  Three employees worked unprotected on top of second floor roof top as they installed the OSB sheathing to the high pitched roof.  The fall distance was approximately 20 feet from the roof top eave to the ground level.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.  a. Located at 7367 Yarrow Run Road (Lot# 1384), Plain City, Ohio: On or about May 20, 2020, the employer failed to ensure that three employees who worked from the roof top of the second floor level of a new build residential home were protected.  The employees positioned to install the OSB sheathing on the high pitched roof, approximately 6 in 12.  The employees were exposed to a fall hazard of approximately 20 feet from the eave of the second floor roof top.
