29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employees ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: a) Aspen Dental Associates of NEPA, PLLC, 1516 Scranton Carbondale Highway, Scranton, Pennsylvania 18508: On or about May 20, 2020, the employer did not provide a medical evaluation to determine the ability of employees to use a respirator before requiring the use. The employer required employees to wear respirators while providing care to patients. b) Aspen Dental Associates of NEPA, PLLC, 1516 Scranton Carbondale Highway, Scranton, Pennsylvania 18508: On or about October 1, 2020, the employer did not provide a medical evaluation to determine the ability of employees to use a respirator before requiring the use. The employer required employees to wear respirators while providing care to patients, including during aerosol-generating procedures. ABATEMENT CERTIFICATION REQUIRED

29 CFR 1910.134(f)(1): The employer did not ensure that employee(s) required to use a tight-fitting facepiece respirator passed the appropriate qualitative fit test (QLFT) or quantitative fit test (QNFT): a) Aspen Dental Associates of NEPA, PLLC, 1516 Scranton Carbondale Highway, Scranton, Pennsylvania 18508: On or about May 27, 2020 to May 29, 2020, the employer required the use of a tight-fitting facepiece respirator after employees failed the fit test and were not retested with other respirator make(s), model(s), or size(s) to assure a good fit. The employer required the employees to wear tight-fitting facepiece respirators to protect against the SARS-CoV-2 virus while providing care to patients. ABATEMENT CERTIFICATION REQUIRED
