(a) At the facility located at 847 County Highway 122, Gloversville, NY 12078: On or prior to 5/1/20, employees, including Nurses and Certified Nursing Assistants, were not medically evaluated to determine their ability to use a N95 filtering facepiece respirator before the employees were fit tested or required to use a respirator in the workplace.

29 CFR 1910.134(f)(2): Employee(s) using tight-fitting facepiece respirators were not fit tested prior to initial use of the respirator: (a) At the facility located at 847 County Highway 122, Gloversville, NY 12078: On or prior to 5/1/20, employees, including Nurses and Certified Nursing Assistants providing direct care to COVID-19 positive residents, were required to wear N95 filtering facepiece respirators. The employer did not ensure that these employees were fit tested for the N95 respirators prior to initial use.
