29 CFR 1926.20(a)(1): The contractor and or subcontractor that employed laborers and mechanics to perform construction work by order of the contract did not provide, as required by Section 107 of the ACT, working conditions that were sanitary and without hazards or danger to their employees health or safety:    a) Kerns Roofing and Restoration at the address of 15335 Highland Drive in Grafton Ohio; On or about May 21, 2020 the employer did not have a plan or program to identify job site hazards which assists employees in maintaining a safe working environment. Such programs would support the employer and employees in identifying and avoiding potential hazards such as, but not limited to, falls during jobsite operations.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:    a) Kerns Roofing and Restoration at the address of 15335 Highland Drive in Grafton Ohio; On or about May 21, 2020 the employer did not ensure that employees had been adequately trained in the appropriate use of fall protection such as, but not limited to, the nature of fall hazards, the use of personal fall arrest systems, or alternative measures of fall protection. Employees were exposed to falls of approximately twenty feet from the peak of the garage roof to the ground below during roof tear off and sheeting operations of a 11/12 peak two story residential roof.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):    a) Kerns Roofing and Restoration at the address of 15335 Highland Drive in Grafton Ohio; On or about May 21, 2020 the employer did not ensure employees were protected from fall hazards while tearing off roofing material of a residential home. Employees working in this manner were exposed to falls of approximately twenty feet from the peak of the roof to the ground below.
