29 CFR 1910.134(d)(1)(i): Selection of appropriate respirators was not based on the respiratory hazard(s) to which the worker was exposed and user factors that affect respirator performance and reliability: Location: Adult Behavioral Unit On or about April 29, 2020, 42 employees who provided direct care to suspect or known COVID-19-positive residents wore surgical masks and were not provided adequate respiratory protection and were potentially exposed to SARS-CoV-2 virus. Appropriate respiratory protection is an N-95 filtering facepiece respirators or the equivalent thereof. The employees were required to be within six feet of the patient to perform tasks such as obtaining vital signs and providing personal care.

29 CFR 1904.39(a)(1): The employer did not report within 8-hours the death of an employee resulting from a work-related incident. Location: Facility On or about 05/20/2020, a COVID-19 workplace fatality was not reported to OSHA within 8-hours as required. An employee passed away on 05/20/2020 and the employer received notification of the employee's death on 05/20/2020. As of 05/22/2020, OSHA had not been notified of the fatality.
