29 CFR 1910.147(c)(4)(i): Procedures were not developed, documented and utilized for the control of potentially hazardous energy when employees were engaged in activities covered by this section: (a) Waste Connections of Colorado at 4218 E. Colfax Ave, Denver, CO: On and around May 19, 2020, the employer had developed and documented Energy Control Procedures but had not ensured that Energy Control Procedures were utilized on a Peterbilt Model 320 garbage truck. A Helper climbed on the truck body to remove a two cubic yard dumpster, which had been released into the hopper of the truck. The hydraulically operated blade in the hopper was activated by the Helper, which caused the Helper's hand to be caught in a pinch point between the dumpster and blade, resulting in amputation. The machine was energized with electrical batteries, a pneumatic system and a hydraulic system. This condition exposed employees to caught-between hazards due to unexpected energization or start-up of the mechanical systems of the garbage truck.

29 CFR 1904.39(a)(2): The employer did not report within 24-hours a work-related incident resulting in in-patient hospitalization, amputation or the loss of an eye. (a) Waste Connections of Colorado at 4218 E. Colfax Ave, Denver, CO: On and around May 19, 2020, the employer failed to report within 24-hours a work-related incident resulting in amputation of a temporary Helper employee's right hand. The injured employee worked for Amass Solutions LLC, a temporary staffing agency, but was under the supervision of host employer, Waste Connections of Colorado, when the injury occurred on May 19, 2020. The injured employee and another employee were attempting to remove a two cubic yard dumpster that had been dropped in the hopper of a Peterbilt Model 210 garbage truck. The blade of the hopper energized and the injured employee's hand was caught in a pinch point between the dumpster and blade, resulting in the amputation of his right hand. The amputation was reported to OSHA approximately 28-hours later on May 20, 2020.
