OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees are exposed to fall and struck-by hazards:   a) Tague Lumber of Media located at 560 East High Street, Philadelphia, PA 19144: An employee was exposed to fall of approximately 15 feet to the lower floor when he was permitted to work from a Hyster H80XM Model (S/N L005V07883D) equipped with Vestil Manufacturing Corporation Aerial Platform Forklift Attachment while on a slope.  Feasible Means of Abatement: The hazard can feasibly be abated by following the Owner's Manual Work Platform Model WP, WP-3131-FD and SP-175, including affixed warning labels and ensuring that the forklift with the attachment is operated on a level surface  before employees occupy the aerial platform.  Condition observed on or about 18 MAY 2020.

29 CFR  1910.178(a)(4):Modifications and additions which affect capacity and safe operation shall not be performed by the customer or user without manufacturers prior written approval. Capacity, operation, and maintenance instruction plates, tags, or decals shall be changed accordingly:  a) Tague Lumber of Media located at 560 East High Street, Philadelphia, PA 19144: The employer did not obtain the manufactures written approval to use the Vestil Manufacturing Corporation Aerial Platform Forklift Attachment as an addition to the Hyster H80XM Model (S/N L005V07883D) powered industrial truck (PIT) which may affect the stability of the  PIT thus exposing the employees to struck-by and fall hazards.  Observed on or about 18 MAY 2020.

29 CFR 1910.178(a)(5): The powered industrial truck was equipped with front-end attachments other than factory installed attachments, however the employer did not request that the truck be marked to identify the attachments and show the approximate weight of the truck and attachment combination at maximum elevation with load laterally centered:  a) Tague Lumber of Media located at 560 East High Street, Philadelphia, PA 19144: The employer did not ensure that a Hyster H80XM Model (S/N L005V07883D) forklift equipped with with Vestil Manufacturing Corporation Aerial Platform Forklift Attachment have updated data plates to indicate the new center of gravity, and the new approximate weight of the truck with the attachment installed, which may affect stability exposing employees to struck-by hazards.  Observed on or about 18 MAY 2020.
