29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix)with worksite specific procedures was not established and implemented for required respirator use: Beginning on or about May 1, 2020 through June 9, 2020, employees were required to wear 3M Model 8511HDX N95 respirators for protection from exposure to the SARS-CoV-2 virus when performing tasks such as, but not limited to, feeding, bathing, maintaining continence, inserting and maintaining IV's, and conducting assessments for suspected or confirmed COVID-19 positive residents. The employer did not establish and/or implement a written respiratory protection program with work-site specific procedures which include the provisions defined in 29 CFR 1910.134(c)(1)(i)- 1910.134(c)(i)(ix). Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d).

29 CFR 1910.134(e)(1): General. The employer shall provide a medical evaluation to determine the employee's ability to use a respirator, before the employee is fit tested or required to use the respirator in the workplace. The employer may discontinue an employee's medical evaluations when the employee is no longer required to use a respirator. Beginning on or about May 1, 2020 through June 9, 2020, nursing home staff were required to wear N95 (3M Model 8511HDX) respirators to protect them from exposure to the SARS-CoV-2 virus when performing tasks such as, but not limited to, feeding, bathing, maintaining continence, inserting and maintaining IV's, and conducting assessments for suspected or confirmed COVID-19 positive residents. The employer did not perform medical evaluations for affected employees in order to determine their ability to wear a respirator. Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d).

29 CFR 1910.134(f)(2): The employer shall ensure that an employee using a tight-fitting facepiece respirator is fit tested prior to initial use of the respirator, whenever a different respirator facepiece (size, style, model or make) is used, and at least annually thereafter. Beginning on or about May 1, 2020 through June 9, 2020, nursing home staff were required to wear N95 (3M Model 8511HDX) respirators to protect them from exposure to the SARS-CoV-2 virus when performing tasks such as, but not limited to, feeding, bathing, maintaining continence, inserting and maintaining IV's, and conducting assessments for suspected or confirmed COVID-19 positive residents. 29 CFR 1904.4(a): The employer did not record each work-related fatality, injury or illness case that resulted in the general recording criteria on the OSHA Form 300 or equivalent. On or about April 22, 2020, the employer did not record work-related illnesses of employees who had occupational exposure to the SARS-CoV-2 virus, which causes COVID-19 when the cases met the criteria for recording: a. A Certified Nursing Assistant (CNA) was hospitalized from on or about April 23, 2020 to April 29, 2020, resulting in at least 6 days away from work. b. A Licensed Practical Nurse (LPN) was hospitalized from on or about April 22, 2020 to April 27, 2020, resulting in at least 5 days away from work. Abatement documentation is required of this item in accordance with 29 CFR 1903.19(d).
