29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:    (a) On or about 05/21/2020 - 503 Town Madison Blvd, Madison, AL 35758, Subcontractor employees were exposed to struck-by and caught under hazards because the forklift operator did not recognize and avoid unsafe conditions applicable to his environment when he lifted a stack of bricks to a height of 27 feet to the scaffold working platform and exited the forklift with the load elevated and resting on the platform.

For falling objects too large, heavy or massive to be contained or deflected, the employer did not place and secure such potential falling objects away from the edge of the surface from which they could fall:    (a) On or about 05/21/2020 - 503 Town Madison Blvd, Madison, AL 35758, Subcontractor employees were installing brick atapproximatley 27 feet above the ground level and employees on the ground were exposed to struck-by hazards because the scaffolding did not have toeboards in place.

The Chris's Masonry, L.L.C.  was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.59, which was contained in OSHA inspection number 1395995, citation number 1, item number 1 and was affirmed as a final order on 9/4/2019 with respect to a workplace located at 7405 Nature Walk Way, Owens Cross Roads, AL.
