29 CFR 1910.134(d)(1)(ii): The employer did not select a NIOSH-certified respirator in compliance with the conditions of its certification: a) Temple University Hospital located at 3401 North Broad Street, Philadelphia, PA 19140: On or about May 30, 2020 and time prior, the employer did not provide NIOSH-certified respirators to employees who were required to care for suspected and confirmed positive COVID-19 patients. The employer provided and required employees to wear respirators labeled "KN95." The KN95 is not a NIOSH-approved respirator and is not manufactured by NIOSH-certificate holder indicating they were not certified under an equivalent international standard.

29 CFR 1910.134(f)(2): Employee(s) using tight-fitting facepiece respirators were not fit tested whenever a different respirator facepiece (size, style, model or make) was used: a) Temple University Hospital located at 3401 North Broad Street, Philadelphia, PA 19140: On or about May 30, 2020 and times prior, the employer did not provide fit tests to all employees required to wear respirators. The employer required employees to wear KN95 filtering facepiece respirators such as the Trust Loyalty & Glory Epoch Network Technology Co., Ltd. KN95 respirator to protect against the SARS-CoV-2 virus while providing care to suspected and confirmed positive COVID-19 patients.
