29 CFR 1910.134(a)(2): A respirator shall be provided to each employee when such equipment is necessary to protect the health of such employee. The employer shall provide the respirators which are applicable and suitable for the purpose intended. The employer shall be responsible for the establishment and maintenance of a respiratory protection program, which shall include the requirements outlined in paragraph (c) of this section. The program shall cover each employee required by this section to use a respirator. a) Gilani Medical Services PC - Brooklyn, NY: The employer did not require the use of filtering facepiece respirators to protect employees from respiratory hazards, such as but not limited to, COVID-19, in accordance with published Centers for Disease Control guidelines for the protection of medical professionals against COVID-19 transmission in the workplace. Employees working in positions such as Doctor, Physician Assistant, and Medical Assistant, were exposed to COVID-19 while receiving and treating symptomatic COVID-19 patients in an outpatient healthcare setting, on or about April 14, 2020 and thereafter.
