29 CFR 1926.100(a): Employees working in areas where there is a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, shall be protected by protective helmets. a. On or about May 28, 2020, located at 3269-3293 Rabbit Hill, Building 4, trusses were being hoisted by a mobile crane and swung near employees that were not wearing any head protection, thereby exposing the employees to a struck-by hazard.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. a. On or about May 28, 2020, located at 3269-3293 Rabbit Hill, Building 4, employees were working on the top of the second-story walls to handle roof trusses for their installation without any means of fall protection, thereby exposing employees to fall hazard between 8 and 20 feet.

On or about May 28, 2020, located at 3269-3293 Rabbit Hill, Building 4, a P&H mobile crane, model CN-122, serial number 56510, was operated to hoist roof trusses. The employer did not ensure that operators of the mobile crane were certified/licensed and evaluated to safely operate the crane.
